These terms govern your purchase and use of Joyeuse. By creating an account, buying a license, or using the software, you agree to them. Please read the payment and refund section (5) and the conduct/termination section (7) carefully. They affect your money and your access.
This is an agreement between you and Joyeuse LLC ("Joyeuse", "we", "us"), a limited liability company organized in Ohio, USA. If you do not agree to these terms, do not purchase or use the software.
Joyeuse is software that processes a video input on your computer and produces output to a connected hardware controller adapter. It is sold as a license to use the software; it is not a physical product, and it requires separate third-party hardware (which you supply) to function.
Subject to these terms and a valid, paid license, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the software for your own use.
You are responsible for keeping your account credentials and license key confidential, and for all activity under your account. Tell us promptly at [email protected] if you believe your account has been compromised. You must provide accurate information and be at least 18 years old.
Prices are shown at checkout. Payment is processed by Stripe. Subscription plans renew automatically for the period you selected until cancelled; you can cancel at any time to stop future renewals.
Licenses terminated for a breach of these terms (see section 7) are not refundable. If you believe a charge is wrong, contact [email protected] before disputing it with your bank. Most issues are resolved faster directly, and we keep records for every order.
Joyeuse requires third-party hardware (a compatible controller adapter and a compatible capture device) that you obtain separately and at your own cost. We do not sell that hardware, and we are not responsible for it. Buying a Joyeuse license does not include any hardware.
You agree not to:
We may suspend or terminate your license or account if you breach these terms. Termination for breach does not entitle you to a refund. If you believe a termination was a mistake (for example, a false detection), contact support and we will review it.
The software may let you connect to model servers or sources that we do not operate or control. Any models or content you obtain from a third-party source are provided by that third party, not by us. We do not host, endorse, or take responsibility for third-party content, and your use of it is at your own risk and subject to that third party's terms.
We may update, change, or discontinue the software or services, and we may require you to update to a current version to keep using it. We aim for good availability but do not guarantee uninterrupted or error-free service.
The software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including (to the maximum extent permitted by law) any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will meet your requirements or operate without interruption or error.
To the maximum extent permitted by law, Joyeuse will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or hardware, arising out of or relating to the software or these terms. Our total liability for any claim is limited to the amount you paid us in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold Joyeuse harmless from claims, damages, and expenses arising out of your misuse of the software or your breach of these terms.
These terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules, and any dispute will be handled in the courts located there.
We may update these terms as the product evolves. We will update the "last updated" date above, and material changes will be communicated by reasonable means. Continuing to use the software after a change means you accept the updated terms.
